Where the website lets you send an enquiry, make a referral or contact us through a form, the information you provide is handled as set out in the Privacy Policy below. Please only submit information you’re authorised to share — for example, if you are referring another person, that you have their consent to give us their details.
4. Intellectual property
Unless stated otherwise, the content on this website — text, images, logos, resources and design — belongs to Psychsense or is used with permission. You may view and download material for your own personal, non-commercial use. Free resources we offer for download may be used in line with any conditions stated alongside them.
5. Links to other websites
Our website may link to other sites for your convenience. We don’t control those sites and aren’t responsible for their content, or for how they handle your information. A link isn’t an endorsement.
6. Accuracy and availability
We take care to keep the website accurate and up to date, but we can’t guarantee it is always complete, current or available. We may change or remove content at any time.
7. Our liability
To the maximum extent permitted by law, we aren’t liable for any loss or damage arising from your use of this website or reliance on its content. Nothing in these terms limits or excludes any rights or guarantees you have that cannot be excluded under the Australian Consumer Law or other applicable law — including any liability for death or personal injury caused by negligence.
8. Changes to these terms
We may update these terms from time to time. The current version will always be on this page, with the “last updated” date above.
9. Governing law
These terms are governed by the laws of Western Australia, Australia, and you agree to the jurisdiction of the courts of Western Australia.
Part B — Privacy Policy
Psychsense is committed to protecting your privacy. We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Because we are a health service, much of the information we hold is “sensitive information” and “health information”, which the law gives extra protection — and we treat it accordingly.
What this policy covers: this policy explains how we handle information collected through our website and initial enquiries or referrals. If you become a client, the way we collect, use and store your clinical records is also covered by the specific consent and privacy information we provide to you as part of intake.
1. The information we collect
- Personal information — such as your name, phone number, email address and postal address.
- Sensitive and health information — when you make an enquiry or referral you may give us information about a person’s health, disability, funding (for example NDIS or Medicare details), the support being sought, and similar details.
- Website usage information — when you visit the site we may automatically collect technical data such as your IP address, browser type, the pages you view and the date and time of your visit.
2. How we collect it
We collect information directly from you — through our online forms, by phone, by email or in person. We may also receive information from someone referring you to us (such as a GP, family member, support coordinator or employer), where they have the authority to provide it. Website usage information is collected automatically through cookies and our website platform.
3. Why we collect and use it
We use your information to:
- respond to your enquiry and process referrals;
- provide our psychology and behaviour support services;
- manage appointments, billing, and Medicare or NDIS claiming where relevant;
- meet our professional, legal and record-keeping obligations; and
- improve our website and services.
We only collect sensitive or health information with your consent, or where we are otherwise permitted or required by law, and only where it is reasonably necessary for our services.
4. When we share information
We do not sell your information, and we don’t disclose it for advertising. We may share information:
- within our team, so the practitioners and staff involved in your care can support you;
- with funders and third parties involved in your care or claims — such as Medicare, the NDIS, plan managers or insurers — where relevant and with your consent;
- with service providers who help us run the practice and website (for example our website host and online-form provider), under confidentiality arrangements;
- where we are required or authorised by law, or where there is a serious risk to health or safety.
Otherwise, we won’t disclose your information without your consent.
5. Information stored outside Australia
Some of the providers we use to run our website and online forms (currently Squarespace and JotForm) may store data on servers located outside Australia, including in the United States. Where this happens, we take reasonable steps to ensure your information is handled consistently with the Australian Privacy Principles.
6. Cookies and website analytics
Our website uses cookies — small files stored on your device — to help the site work and to understand how it’s used. You can set your browser to refuse cookies, though some parts of the site may not work as well. We may use website analytics to see how visitors use the site so we can improve it.
7. Keeping your information secure
We take reasonable steps to protect your information from misuse, loss, and unauthorised access or disclosure, through a combination of physical, electronic and procedural safeguards.
8. How long we keep it
We keep your information only for as long as needed for the purposes above and to meet our legal obligations. Health records are kept in line with legal requirements — generally at least 7 years from your last appointment for adults, and for a child, until they turn 25.
9. Accessing and correcting your information
You can ask to see the personal information we hold about you, and to have it corrected if it’s wrong or out of date. Contact us using the details below and we’ll respond within a reasonable time. In some cases the law allows us to decline a request, and if so we’ll explain why.
10. Making a privacy complaint
If you have a concern about how we’ve handled your information, please contact us first — we take privacy seriously and will work with you to resolve it. If you’re not satisfied, you can contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au or on 1300 363 992.
11. Changes to this policy
We may update this policy from time to time. The current version will always be on this page, with the “last updated” date shown at the top.
